Danielle Duggleby Interior Design TERMS AND CONDITIONS OF SERVICE
1.0 GENERAL
This contract sets out the terms and conditions upon which Danielle Duggleby Interior Design has been engaged for supply of Design Service.
These are the services as described in the scope of works. These are the ongoing works of Danielle Duggleby Interior Design during the supply of the Scope of Works and may include, but is not limited to all conceptual and design work, developing and refining the design, and detailed preparation of estimates.
2.0 SCOPE OF WORKS
This is the list of works actionable by Danielle Duggleby Interior Design , set out in agreement with the client prior to appointment, which can include but not be limited to the following;
Site meeting and survey (if this option has been chosen and payment of £169 has been made)
Concept design (this is initial design ideas for the rooms previously agreed by client and Danielle Duggleby Interior Design
Layouts (1 or 2 options will be provided for discussion at Dalodu’s discretion)
Elevations (these will be provided if agreed at an additional fee)
Developed design (this will be all information listed above but finalised to include clients comments)
Shopping list (a shopping list will be provided for max 15 items per room, 2 alternatives will be included for certain items but not all)
Final Design documentation (documentation which will include all final design which would of received client approval in developed design stage)
3.0 APPROVAL AND SIGN OFF
The client will approve layout, design and shopping list in the developed design stage prior to final design documents being sent. The client will provide comments on the PDF document produced and in the comments column in the shopping list
4.0 DESIGN FEE
This is the proposed and agreed amount by Danielle Duggleby Interior Design and client based on scope of work and project size. Danielle Duggleby Interior Design requests 50% of fee to be paid upfront and 50% balance when final documents have been sent, prior to final site visit. Danielle Duggleby Interior Design will not commence work until payment is received.
5.0 TIMESCALE AND DURATION
The project will commence at an agreed date between client and Danielle Duggleby Interior Design.
Once each stage (concept & developed) has been sent, Danielle Duggleby Interior Design expects comments or sign off within 7 working days.
6.0 ADDITIONAL TO THE SCOPE OF WORKS
Additional design information can be provided for an additional agreed fee. These additional information could include but are not limited to;
Joinery drawings
Details lighting layout
Detailed site survey
Styling including additional shopping list including accessories
Procurement
Implementation
Project management
7.0 PAYMENT DETAILS
Danielle Duggleby Interior Design will invoice prior to work commencing. Payment should be paid within 7 days of receipt of invoice date.
8.0 THE PRICE AND PAYMENT AND ORDERING OF GOODS
All prices quoted for goods are given at the time of work completed, Danielle Duggleby Interior Design can not be liable for any price changes that a supplier or retailer may make. All payments and ordering of goods will be done by the client unless stated and agreed with both parties.
9.0 OPTIONAL EXTRAS
Danielle Duggleby Interior Design will provide up to 15 items, 2 options for key pieces and 1 iteration included anything requested additional to this will be chargeable of an additional fee
10.0 DESIGN REVISIONS
1 design revision from concept to developed design and 1 further from developed design to final design, making that 2 professional revisions, will be included anything further to this will be charged extra either at an hourly rate of £80/hr or daily rate of £450
11.0 DELIVERABLES
Completion dates and best estimates. Completion dates represent Danielle Duggleby Interior Design’s best estimates and whilst Danielle Duggleby Interior Design will use all reasonable endeavors to meet such dates, no liability is accepted by Danielle Duggleby Interior Design if any date is not met due to unforeseen circumstances out of Danielle Duggleby Interior Design’s control, unless otherwise agreed in writing.
12.0 SUSPENSION AND TERMINATION
In the event of the Client being in default of payment of any fees and/or expenses, Danielle Duggleby Interior Design may suspend performance of any design work.
If no payment is received within 28 days of the due date Danielle Duggleby Interior Design may terminate the contract. Without prejudice to any other claim or remedy available to Danielle Duggleby Interior Design on termination of the contract for any reason other than Danielle Duggleby Interior Design default Danielle Duggleby Interior Design shall be entitled to, and shall be paid, a design fee calculated according
to the amount of design time spent up to the date of termination, in each case
based on DDID’s standard hourly rate.
13.0 DISPUTES
Danielle Duggleby Interior Design and the Client will attempt to resolve any disputes amicably. All disputes arising under this Contract shall be governed by English law and will be within the exclusive jurisdiction of the English courts. In the event of dis-instruction Danielle Duggleby Interior Design reserves the right to charge for operational time cost incurred, designers hourly rates, work carried out to date, out of pocket expenses, disbursements etc. incurred accordingly
14.0 Liability
Danielle Duggleby Interior Design does not accept responsibility or liability for any incorrect pieces of furniture or items ordered by you or a third party, or furniture that may be the wrong size, wrong colour or arrive damaged, whether or not ordered by us. Danielle Duggleby Interior Design does not accept any responsibility for any pieces ordered by you that do not meet your satisfaction and needs to be returned for any reason. Danielle Duggleby Interior Design works on the assumption that you, the client, has made all the relevant checks to ensure furniture will pass through your house, into the desired room and you are satisfied prior to purchasing.
15.0 COPYRIGHTS
Copyright in all documents and drawings prepared by Danielle Duggleby Interior Design shall remain the property of Danielle Duggleby Interior Design. All intellectual rights remain the property of Danielle Duggleby Interior Design.
16.0 MEDIA COVERAGE
Unless agreed otherwise, Danielle Duggleby Interior Design reserves the right to request to use completed projects for media coverage in press and magazine publications, removing any personal items at the clients request.
17.0 WORKING & CONTACTABLE HOURS
